Import Tariffs: Turning Up The Heat On Tariff Evasion

The U.S. trade compliance landscape is undergoing a calculated shift, forcing importers to reassess compliance practices, systems, and technology around imported goods and tariff exposure. In early 2025, the emphasis of trade enforcement policy transitioned strategically from national security and export controls (e.g., microchips, military technology, dual-use products) to an increased focus on economic security and import tariffs, with the current administration expanding enforcement capacity and coordination to bring intense scrutiny to tariff evasion and customs fraud.

The crackdown on tariff evasion is no surprise given that import tariffs have become a tremendous revenue source for the government: U.S. Customs and Border Protection (CBP) collected a record-breaking $200 billion in tariff revenue in 2025. With such large sums at stake, the administration launched a cross-agency Trade Fraud Task Force (TFTF), allocating an additional $2 million in funding for the TFTF at the start of 2026.

This task force brings together the civil and criminal investigative arms of the U.S. Department of Justice (DOJ), Homeland Security, and CBP to “enhance efforts to prevent trade fraud that deprives the government of vital revenues, threatens critical domestic industries, undermines consumer confidence, and weakens national security.”

In the same vein, the DOJ expanded whistleblower incentives to encourage the trade community and general public to report suspected trade violations under the False Claim Act (FCA). The FCA imposes treble damages and penalties on those who knowingly and falsely claim money from the United States or knowingly fail to pay money owed to the United States.

This enforcement avenue is paying off: settlements and judgments under the FCA exceeded $6.8 billion in fiscal 2025 — the highest in a single year, with whistleblowers filing 1,297 qui tam lawsuits. In fact, whistleblowers are a force multiplier; depending on the size of the FCA settlement, tipsters’ monetary reward can run into the millions, reinforcing incentives to report tariff evasion.

How Fraudsters (Unsuccessfully) Evade Import Tariffs

With the cost of import tariffs potentially in the millions of dollars, companies are legitimately tasking their trade compliance teams to mitigate tariff exposure. However, some bad actors are pushing the legal boundaries to protect the bottom line.

From undervaluing imported items, misclassifying Harmonized Tariff Schedule (HTS) codes, and creating illegitimate shell companies to misrepresenting country of origin and dodging anti-dumping and countervailing duties, fraudsters are getting creative with tariff evasion tactics.

Illegal transshipment is a particularly deceptive tactic, often used to disguise an import’s country of origin to avoid duties. For example, in addition to knowingly misclassifying HTS codes and failing to pay marking duties, a North Carolina-based distributor of tungsten carbide products agreed to a $54.4 million FCA settlement to resolve a qui tam complaint alleging that the company transshipped Chinese‑origin products through Taiwan, falsely declaring Taiwan as the country of origin to avoid Section 301 tariffs.

In another recent country-of-origin deception, MGI International, a global plastic resin distributor, agreed to pay $6.8 million to resolve an FCA liability. The company mispresented the country of origin on paperwork submitted to CBP to avoid paying duties totaling more than $4.5 million owed on products imported from China.

Notably, while CBP historically relied on administrative remedies (e.g., fines, liquidated damages), the DOJ raised the stakes in 2025, shifting tariff fraud into the civil and criminal arena. In this instance, MGI’s former chief operating officer pleaded guilty to one count of conspiracy to smuggle goods into the U.S. and faces a maximum penalty of five years in prison — a high personal price to pay for attempting to evade import tariffs.

Best Practices to Balance Risk with Profits

As the DOJ scales tariff enforcement via the cross-agency TFTF, pairing civil tools with criminal pathways, companies must prioritize transparency, accuracy, and accountability in their compliance programs. Import tariffs errors can become an FCA exposure — not just a customs penalty — if authorities view duty underpayment as knowingly avoiding an obligation. The key is to separate defensible tariff mitigation strategies from tariff evasion risk.

When properly documented, there are tariff mitigation strategies that can legally reduce exposure:

Binding rulings on classification and origin (reduces ambiguity before entry)
Product engineering that changes classification (applicable only if the product truly changed)
Supplier diversification and lawful origin shifts (with real manufacturing change)
Foreign trade zones (FTZs) and duty drawback (when operationally feasible)
First sale (where legally available and properly structured)

In contrast, high-risk tactics tend to trigger investigations:

Declaring an origin that doesn’t match manufacturing reality, including “pass-through” routing
Reclassifying at scale without technical support, especially when elimination of duty is the outcome
Ignoring marking requirements or treating them as a downstream packaging issue

Next Steps

As tariff volatility and intensifying DOJ pressure push companies to revisit sourcing, classification, and landed cost models, compliance leaders need an import tariff framework that helps them understand their evolving exposure, optimize classification processes to ensure accuracy and auditability, and manage high-risk areas (e.g., Chinese imports) — all at scale.

First and foremost, building a single source of truth for classification and duty factors helps companies mitigate misclassification risk, one of the most common yet preventable failure points. In addition, importers should ensure country of origin links to inscrutable manufacturing steps and supplier attestations, especially for goods potentially affected by Section 301 or antidumping and countervailing duties.

And perhaps most importantly, by calibrating compliance process for auditability with an automated, scalable trade compliance solution, organizations can ensure the accuracy and defensibility to withstand intense scrutiny in today’s rapidly-evolving trade environment.

Digital supply chains are not built from dashboards alone. Siemens shows that the real foundation is the connection between engineering, production, automation, and operational data, not just planning software, analytics, or AI.

In practice, digitization starts upstream in engineering and runs through production via automation, plant-floor data, product definitions, and process control, then reaches enterprise decisions. Siemens illustrates this industrial layer because it sits at the intersection of automation, manufacturing software, electrification, infrastructure, and digital engineering.

Not every company will look like Siemens, but the lesson holds: if the systems below the dashboard are disconnected, the “digital supply chain” becomes a presentation layer.

Digital Supply Chains Begin Before the Supply Chain Function

Many companies treat digital supply chain transformation as a planning initiative – forecasting, visibility, inventory decisions, and execution. Those goals are valid, but much of the information that makes planning accurate is created outside the supply chain function.

Product specifications come from engineering; production constraints from manufacturing; quality signals from the plant floor; and asset performance from operations. Supplier constraints may sit in materials, tooling, capacity, or compliance systems. When these layers are disconnected, planning works with an incomplete view of reality.

That is why Siemens matters: its strength is linking engineering data, automation systems, manufacturing execution, and operational control.

The Industrial Layer Determines Data Quality

This is also where data quality is won or lost, and it is not a back-office issue. Supply chain performance depends on industrial data such as machine status, yield, quality exceptions, labor constraints, changeover times, and material usage.

When operational signals are late, inconsistent, or trapped in local systems, the enterprise view is distorted. Planning may show available capacity while the plant knows it is constrained by tooling, labor, quality holds, or equipment condition. The plan is only as good as the operational inputs feeding it—this is where the industrial backbone becomes strategic.

The Digital Thread Is the Real Prize

The digital thread- the continuity from product design through manufacturing, supply chain execution, service, and feedback- is easy to describe and difficult to execute at scale.

Design must be manufacturable; constraints must inform planning; and quality issues must connect to suppliers, processes, and design assumptions. Many companies digitize parts of the process, but the parts do not share enough context to prevent downstream surprises.

The result is familiar: engineering, manufacturing, supply chain, and finance each have a different view. Each view may be accurate, yet together they still fail to describe how the business actually runs day to day.

Digital Twins Need Operational Depth

Digital twins are often framed as simulation tools, but a useful twin depends on live, accurate, structured operational data. A weak twin is visualization; a strong twin reflects real constraints, dependencies, and operating conditions.

This requires industrial depth. Siemens’ role in automation, manufacturing software, and industrial data shows why twins are built from the connection between the physical system and its digital representation.

The implication shows up quickly in scenario planning. It is only useful if scenarios reflect operational reality. Models that ignore production constraints, supplier dependencies, or equipment limits produce elegant but unreliable answers.

AI Depends on the Industrial Backbone

The same dependency applies to AI. In supply chains, AI will be limited less by model intelligence than by the quality, structure, and timeliness of industrial data.

If the system does not know the real state of the plant, inventory, production constraints, or sources of quality variation, AI outputs will be incomplete. The industrial layer is not separate from supply chain strategy; it is where many of the decision signals originate.

Effective AI requires stronger instrumentation – and integration between industrial and enterprise systems. That is the backbone.

The Lesson for Supply Chain Leaders

The Siemens example points to a broader lesson: transformation is not just adding software on top of operations; it is connecting the enterprise operating system. For supply chain leaders, that means knowing where data originates, what context is lost between systems, and where constraints are hidden – before those gaps show up as inventory, service, or cost problems.

The most important questions are practical:

Does planning know what production can actually do?

Does manufacturing know what demand is really signaling?

Does engineering understand supply chain consequences?

Does the enterprise have a consistent view of products, assets, locations, and constraints?

These questions determine whether digital supply chains become real, or remain presentation-layer projects. Siemens illustrates the point: they are built from connected industrial systems, not dashboards.

Nearshoring Is Creating New Infrastructure Bottlenecks

Nearshoring can reduce exposure to long global supply chains, but it also shifts pressure onto regional infrastructure, labor markets, energy systems, and cross-border logistics.

Nearshoring has become one of the more visible responses to recent supply chain disruption. The premise is clear: move production closer to demand, shorten lead times, reduce reliance on distant suppliers, and improve responsiveness.

That logic holds.

But as companies shift production toward Mexico, the United States, and other regional hubs, a different set of constraints is emerging. Risk is not eliminated. It is redistributed.

Infrastructure is one of the clearest examples.

Production Can Move Faster Than Infrastructure

Manufacturing capacity can often be added faster than the systems that support it.

Factories can be expanded, suppliers onboarded, and sourcing strategies adjusted within a few years. Infrastructure moves on a different clock. Roads, rail lines, ports, power grids, water systems, and industrial parks require permitting, financing, construction, and coordination across public and private stakeholders.

That creates a lag.

Production may shift toward North America, but the logistics and utility networks required to support that shift may not scale at the same pace. The result is not necessarily a national bottleneck. More often, it is a set of localized constraints in regions experiencing rapid industrial growth.

The Border Becomes a Critical Node

For companies using Mexico as a manufacturing base for the U.S. market, the border becomes one of the most important points in the supply chain.

This creates a different form of dependency.

Instead of relying on long ocean routes, companies rely more heavily on cross-border trucking, customs clearance, inspection processes, and border infrastructure. Even modest delays at high-volume crossings can affect tightly coordinated supply chains.

Northern Mexico industrial corridors and high-volume crossings such as Laredo illustrate the issue. Nearshoring can shorten distance, but it can also concentrate more freight through specific regional chokepoints.

Nearshoring reduces distance. It can also increase reliance on border throughput.

Transportation Networks Are Being Rebalanced

Nearshoring changes freight patterns.

Some long-haul ocean movements are replaced by regional trucking and intermodal flows. That places more demand on north-south transportation corridors, rail networks, inland ports, and distribution centers.

Capacity across those networks is uneven. Some corridors are well developed and can absorb additional volume. Others were not built for the level or direction of demand now emerging.

This is one of the practical complications of nearshoring. The manufacturing footprint may change before the logistics network fully adapts.

Labor Is a Binding Constraint

Manufacturing expansion depends on labor availability.

In several nearshoring regions, particularly in northern Mexico and parts of the southern United States, demand for skilled labor has increased. That affects hiring, training, productivity, and operating consistency.

Labor constraints can show up in several places:

Factory ramp-up timelines
Warehouse operations
Transportation capacity
Maintenance and technical roles

A location may appear attractive based on cost and proximity. If the labor market cannot support sustained operations, the expected advantage narrows.

Energy and Utilities Are Under Pressure

Industrial activity requires reliable access to power, water, and supporting utilities.

In some regions, those systems are already under strain. Energy reliability, grid capacity, and water availability are becoming more important in site selection and long-term planning.

This is especially relevant for energy-intensive industries and automated facilities. As operations become more digitized, tolerance for utility disruption decreases.

Infrastructure constraints are not limited to logistics. They also include the basic systems required to keep production running.

Inventory Strategy Is Changing

Nearshoring is often expected to reduce inventory requirements by shortening lead times.

In some cases, it will.

But the outcome is not automatic. Variability in border crossings, transportation capacity, labor availability, and regional infrastructure can introduce new forms of uncertainty. Companies may still need safety stock to manage these risks.

The inventory buffer does not disappear in every case. It may shift location and purpose.

Instead of protecting primarily against long ocean lead times, inventory may protect against regional execution variability.

The New Bottlenecks Are Regional

Global supply chain risk has often been associated with distant sourcing, long transit times, and port congestion.

Nearshoring changes the risk profile.

The emerging constraints are closer to the point of production and consumption:

Border throughput
Regional transportation capacity
Labor availability
Energy and utility infrastructure
Local supplier depth

These factors determine whether nearshoring delivers the expected benefits.

The Takeaway

Nearshoring remains a sound strategy for many companies. It can reduce lead times, improve responsiveness, and lower exposure to some distant disruptions.

But it is not simply a relocation of production.

It is a redesign of the supply chain network.

The companies that benefit most will treat nearshoring as a network design problem rather than a sourcing decision. They will evaluate infrastructure, labor, utilities, and transportation capacity with the same rigor they apply to cost and proximity.

Planning AI Needs Memory, Not Just Automation

AI can make planning work faster, but speed is not the same as intelligence. The next stage of supply chain planning requires systems that retain context, learn from exceptions, and preserve the judgment of experienced planners.

Supply chain planning has always depended on memory.

Not just data. Not just forecasts. Not just optimization logic.

Memory.

Experienced planners remember what happened the last time a supplier missed a shipment. They remember which plants can absorb a schedule change and which cannot. They know which customers need immediate communication, which carriers recover well from disruption, and which workarounds tend to create problems downstream.

That knowledge rarely lives cleanly inside a planning system.

It lives in people, spreadsheets, email threads, tribal routines, and informal escalation paths. It is built over years of handling exceptions, resolving shortages, negotiating tradeoffs, and learning which system recommendations are useful and which are technically correct but operationally unrealistic.

As AI moves into supply chain planning, this distinction becomes important.

Many AI tools can automate tasks. They can summarize exceptions, draft responses, generate recommendations, classify alerts, and explain variance. Those capabilities matter. They reduce administrative load and make planning systems easier to use.

But automation is not the same as planning intelligence.

The more important question is whether AI can remember, learn, and apply operational context over time.

Blue Yonder has announced AI-driven planning and execution capabilities, including planning agents, improved forecast accuracy, inventory optimization, and real-time decisioning. o9 Solutions positions its Digital Brain and Enterprise Knowledge Graph around unifying data, intelligence, execution, and decision-making across the enterprise.

The common thread is clear: planning is no longer being treated only as a periodic batch process. It is being reframed as a continuous decision system.

Traditional planning systems were built to create plans. Modern planning platforms are increasingly expected to interpret events, evaluate scenarios, recommend actions, and coordinate across functions. The next market boundary will be how deeply these systems can retain context, learn from outcomes, and operationalize planning memory.

Planning Is an Exception-Driven Discipline

Planning is often described as a structured process. Demand planning generates a forecast. Supply planning balances capacity and materials. Inventory planning sets buffers. Sales and operations planning reconciles demand, supply, and financial objectives. Execution teams then work from the plan.

That is the clean version.

The actual operating environment is less orderly. Demand changes. Suppliers miss dates. Production yields shift. Transportation capacity tightens. Promotions overperform. Customers revise orders. A port slows down. A warehouse hits a labor constraint. A production line loses a critical component. A supplier has material available, but not in the right region. Inventory exists, but not in the node where demand is emerging.

This is where planning work becomes difficult.

The planner is no longer executing a standard workflow. The planner is interpreting conflicting signals, weighing tradeoffs, and deciding what to do under imperfect information.

That work depends heavily on context.

A shortage is not just a shortage. It matters which product is involved, which customer is affected, whether substitution is possible, whether expediting is available, whether the supplier has failed before, whether the demand signal is reliable, and whether similar exceptions have occurred in the past.

Traditional systems can show parts of this picture. They can identify a constraint, report available inventory, or calculate projected service impact. But they often do not retain the practical learning that comes from resolving the exception.

That is the memory gap.

The Limits of Automation in Planning

Automation works best when the process is stable, repeatable, and governed by clear rules.

If an order meets a threshold, route it for approval. If inventory falls below a reorder point, generate a replenishment signal. If a shipment is delayed, trigger a notification. If a forecast variance exceeds a tolerance, create an alert.

These are useful functions. But planning is not only a rules problem. It is also a context problem.

The same apparent exception may require different responses depending on history, geography, customer priority, supplier behavior, margin impact, and downstream constraints. A rule-based workflow may detect that something is wrong, but it may not understand what the organization has learned from similar situations.

That creates an important consideration as AI is added to planning systems.

If AI is deployed only as a faster automation layer, it may accelerate existing processes without necessarily improving the quality of the underlying decision. It may classify exceptions faster, generate plausible recommendations faster, and push work through the system faster. But if it lacks memory, it may not fully reflect what the organization has learned from prior events.

Speed is valuable when the underlying decision logic is sound.

An AI assistant that cannot remember prior outcomes may recommend the same action that failed last quarter. A planning copilot that lacks supplier-specific context may treat two vendors as equivalent because their master data looks similar. A recommendation engine that does not retain planner feedback may continue surfacing options that users consistently modify or reject.

This is workflow assistance. It can be useful, but it is not sufficient on its own if the objective is adaptive planning intelligence.

Why Memory Matters in Planning AI

Memory matters because supply chains are cumulative systems.

Every exception leaves behind information. Every supplier delay, expedite decision, substitution, missed forecast, customer escalation, and recovery action contains learning. The organization becomes better when that learning is captured and reused.

Without memory, the same lessons are relearned repeatedly.

A planner discovers that a supplier’s lead time is unreliable during a specific season. Another planner later encounters the same issue without that context. A transportation team learns that a lane is vulnerable during certain weather patterns. That insight remains local. A customer service team learns that a customer will accept partial allocation if notified early. That knowledge stays in email history.

The planning system may contain the transaction. It may not contain the lesson.

This is one reason experienced planners are so valuable. They carry operating memory that is broader than formal data. They understand patterns that are not always visible in dashboards. They know when to challenge the system and when to trust it.

AI can help preserve and scale this judgment, but only if memory is designed into the architecture.

That means a planning AI should not merely answer the current question. It should be able to connect the current event to prior events, prior decisions, and prior outcomes.

The better question is not, “What is the recommended action?”

The better question is, “Given what we have seen before, what action is most likely to work in this situation?”

Customer and Case-Study Signals

Public customer and case-study material points in the same direction. Kinaxis cites Merck’s use of RapidResponse for shelf-life planning, including a statement from a Merck supply chain director that the company was able to manage shelf-life planning at a level of detail that helped reduce write-offs due to expiry. Kinaxis states NORMA Group reduced forecasting time from weeks to hours and highlights rapid decision-making and improved customer response time. Similarly, o9’s public food-and-beverage case material emphasizes the role of its knowledge graph in incorporating leading indicators of demand and turning those signals into more accurate forecasts and commercial insights.

These examples should not be overread. They are vendor-published customer and case-study materials, not independent benchmark studies. But they are directionally useful because they show where the market narrative is going.

The story is not simply faster planning. It is more granular planning, more contextual planning, more scenario-aware planning, and more connected planning.

That is why memory matters. A planning system that can connect product shelf life, forecast behavior, demand signals, supplier performance, customer commitments, and prior mitigation outcomes is more useful than a system that only accelerates the current workflow.

What Planning Memory Should Capture

Planning memory needs to be more than a chat history.

A useful memory layer should capture structured operational context. It should associate events with the entities that matter in supply chain planning: suppliers, customers, products, plants, distribution centers, carriers, lanes, purchase orders, production lines, and service commitments.

It should also capture the relationship between decisions and outcomes.

For example, if a supplier misses a shipment, the system should not only log that the shipment was late. It should retain what happened next. Was inventory reallocated? Was production rescheduled? Was an alternate supplier used? Was the customer notified? Did the expedite work? Did the decision protect service, or did it create excess cost?

That outcome history becomes valuable in future planning cycles.

The same applies to demand planning. If forecast error increased during a promotion, the system should retain the context. Was the error caused by customer behavior, poor promotional visibility, regional allocation, weather, pricing, or product substitution? Did the planner override the forecast? Was the override more accurate than the model?

Memory should also capture planner feedback. If users repeatedly reject a recommendation, the system should learn from that pattern. If certain actions are accepted only under specific conditions, that should become part of the decision logic.

In this sense, planning memory is not just storage. It is the foundation for organizational learning.

Implementation Requires More Than a Copilot

The implementation path matters.

Many companies will be tempted to begin and end with a planning copilot. That is understandable. A natural language interface is visible, easy to demonstrate, and useful for productivity. It can help planners ask questions, summarize exceptions, and generate narratives.

A copilot can be valuable, but its strategic value increases substantially when it is connected to an operating memory layer.

A stronger implementation model starts with five layers.

First, companies need a planning data foundation. That includes demand history, inventory positions, supplier performance, order status, production constraints, transportation events, customer commitments, and financial targets. The data does not need to be perfect, but it must be governed, mapped, and trusted enough to support decisions.
Second, companies need entity resolution. The system must know that a supplier, customer, product, or location appearing under different codes or naming conventions is the same operating entity. Without this, memory fragments across systems.
Third, companies need an event and exception history. Every meaningful planning exception should be logged with cause, action, owner, timing, and outcome. This is where many organizations are weak. They capture the transaction, but not the resolution logic.
Fourth, companies need feedback loops. Planner overrides, approvals, rejections, and manual workarounds should become learning signals. The system should know which recommendations were accepted, which were rejected, and what happened after the decision.
Fifth, companies need governance. Memory cannot be treated as an uncontrolled accumulation of old decisions. Some prior actions were good. Some were emergency workarounds. Some were driven by temporary conditions. Some should not be repeated. The memory layer must be auditable, weighted, and subject to business rules.

This is why planning AI implementation is not only an IT project. It is a process redesign and operating-model project.

A Practical Implementation Roadmap

A practical roadmap should start narrow.

The mistake is to try to build memory for the entire planning organization at once. The better approach is to select a high-value planning domain where exceptions are frequent, outcomes are measurable, and experienced planner judgment clearly matters.

Good starting points include supplier delivery exceptions, demand forecast overrides, inventory allocation decisions, capacity-constrained production planning, transportation-related replenishment delays, and customer service prioritization during shortages.

The first implementation step is to define the decision object. For example, in supplier delivery exceptions, the decision object might be: what is the best mitigation action when a critical supplier shipment is at risk?
The second step is to define the memory fields. These may include supplier, part, plant, lane, delay reason, severity, available inventory, customer exposure, mitigation action, cost, service outcome, and planner comments.
The third step is to capture historical cases. Companies do not need years of perfect data to begin. Even 90 to 180 days of well-structured exception history can expose recurring patterns.
The fourth step is to connect retrieval. When a new exception occurs, the system should retrieve similar historical cases, not just generic policy documents.
The fifth step is to introduce recommendations with human review. Early-stage memory-enabled AI should support planners, not act autonomously. The planner should see the recommendation, the supporting history, and the confidence level.
The sixth step is to track outcomes. Did the recommendation work? Did the planner modify it? Did the mitigation protect service? Did it create unexpected cost?
The seventh step is to scale to adjacent decision areas.

This staged approach avoids the common failure pattern of trying to deploy enterprise-wide AI without a clear decision model.

Market Implications for Buyers

The planning software market is becoming harder to evaluate because the language used across the category is converging.
